These Terms of Service apply to the use of the NS PROMO website and to enquiries, quotes, orders, artwork services, custom printing, embroidery, garment supply, production, delivery and related services provided by NS PROMO.

By using our website, requesting a quote, submitting artwork, approving a mock-up, placing an order or making payment, you agree to these Terms of Service.

If we enter into a separate written agreement with you, that agreement will apply to the extent of any inconsistency with these Terms of Service.

NS PROMO is a Sydney-based custom uniform printing and embroidery studio supplying customised apparel, logo printing, embroidery, artwork preparation, bulk uniform support and related services.

2. Product and service information

We aim to describe our products and services accurately, including garment type, material, colour, size, decoration method, production requirements and availability.

Product images, colour samples and mock-ups are provided to help customers understand the intended product. Minor differences may occur because of screen settings, photography, lighting, fabric texture, dye batches and normal production tolerances.

This does not limit any rights that apply where a product is materially different from its description, approved specifications or sample.

Product availability may change because garments are sourced from third-party suppliers. If an ordered product becomes unavailable, we will contact you to discuss a suitable alternative, revised timeframe, credit or refund as appropriate.

3. Quotes and pricing

Quotes are based on the information provided by the customer, including garment type, quantity, sizes, colours, logo placement, artwork complexity, production method, required date and delivery requirements.

Prices may change if the requested order details change, including quantity, garment style, size range, artwork, logo position, production method, delivery address or turnaround time.

Unless stated otherwise, a quote is valid for the period shown on the quote. If no validity period is shown, pricing and availability must be confirmed before the order is accepted.

Prices displayed on our Australian website and at checkout are in Australian dollars and include GST where applicable, unless clearly stated otherwise. Quotes and invoices will indicate whether GST is included.

The price confirmed at checkout or on an accepted quote will not be changed after order acceptance unless you request or approve a change to the order.

4. Orders and payment

Submitting an order, quote request or payment does not require us to accept an order. An order is confirmed when NS PROMO accepts it and receives any required payment or deposit.

For custom orders, production will generally begin only after payment confirmation and artwork, mock-up or order-detail approval, unless otherwise agreed in writing.

For larger or bulk orders, a deposit may be required before production, with the balance payable before dispatch, collection or completion, unless otherwise agreed in writing.

You are responsible for checking the products, quantities, sizes, colours, artwork, delivery details and other information shown in the order or quote before making payment or providing final approval.

5. Artwork, logos and customer-supplied content

You are responsible for ensuring that you have the necessary rights and permissions to use any logo, artwork, trademark, image, design, name, slogan or other content supplied to NS PROMO.

By submitting artwork or other content, you confirm that you are authorised to use it for the requested products and services and to allow NS PROMO to reproduce it for that purpose.

NS PROMO may decline content that we reasonably believe is unlawful, misleading, offensive, infringing or otherwise unsuitable for production.

Artwork supplied in low resolution, poor quality, an incorrect format or an unsuitable condition may require adjustment, recreation or additional preparation. We will advise you where reasonably practical if additional artwork charges apply before carrying out chargeable additional work.

6. Mock-ups, proofs and approvals

Where a mock-up, proof or design preview is provided, it is intended to show the proposed artwork, placement and general appearance of the product.

It is your responsibility to carefully check the mock-up and order details before approval, including:

• logo and artwork;
• spelling and contact information;
• colours;
• garment style and size;
• artwork size and position;
• quantity; and
• any other requested production details.

Once a mock-up, proof or order detail has been approved, NS PROMO may proceed with sourcing and production. Changes requested after approval may not be possible and may incur additional costs where work has already been completed or materials have been ordered.

Approval does not remove any rights that cannot legally be excluded where the finished product fails to meet an applicable consumer guarantee.

7. Colour, sizing and normal variation

Product colours may appear differently depending on screen display, lighting, photography, fabric type, dye batch and production conditions.

Garment measurements may vary slightly because of normal manufacturing tolerances, fabric properties and garment construction. Size charts are provided to assist with selection but cannot guarantee that a particular style will suit every body shape or personal fit preference.

Customers should review the applicable size chart rather than relying only on their usual size label. If exact colour, fit or sizing is critical, we recommend requesting a sample or checking the product specifications before confirming the order.

Normal minor production variation does not include a material error in the approved garment, size, artwork, spelling, colour or decoration specifications.

8. Printing, embroidery and decoration

NS PROMO will provide printing, embroidery and related decoration services with reasonable care and skill.

Results may vary depending on fabric composition, garment colour, surface texture, artwork complexity, logo size, thread, ink, transfer material and placement.

Not every garment or artwork is suitable for every decoration method. Where reasonably practical, we may recommend an alternative garment, artwork adjustment or production method.

Any material change from an approved order or mock-up will be discussed with the customer before production where reasonably possible.

9. Production timeframes

Production timeframes are separate from delivery timeframes.

Production estimates generally begin after required payment has been received and artwork, mock-up and order details have been approved.

Production may be affected by artwork approval, payment timing, stock availability, supplier delays, order quantity, garment type, production capacity or events outside our reasonable control.

We will make reasonable efforts to meet an agreed or estimated timeframe. If we become aware of a material delay, we will provide updated information where reasonably practical.

If we cannot supply products or services within an agreed or reasonable time, the matter will be addressed in accordance with applicable law and the circumstances of the order.

10. Urgent and express orders

Urgent or express production may be available for selected products and suitable artwork, subject to stock availability and production capacity.

Please contact us before placing an urgent order so we can confirm whether the requested production and delivery timeframe is reasonably achievable.

Additional charges may apply for urgent production, artwork preparation, express handling or faster delivery. Any applicable charges will be disclosed before the urgent service is confirmed.

11. Order changes and cancellations

Requests to change or cancel an order must be submitted in writing as soon as possible.

Custom production may begin shortly after payment and artwork approval. Once garments have been ordered, artwork has been prepared, production has begun or decoration has been completed, an order may not be able to be changed or cancelled.

If we accept a cancellation after costs have been incurred, we may deduct or charge reasonable costs for garments or materials ordered, artwork preparation, completed production and other non-recoverable work directly related to the order.

We will explain any applicable cancellation cost based on the work completed and costs incurred. This section does not limit any cancellation or refund right that cannot be excluded under applicable law.

12. Returns, exchanges and refunds

Custom printed, embroidered, decorated, altered, specially ordered or personalised products are not eligible for return, exchange or refund because of change of mind, unsuitable fit, incorrect customer size selection, incorrect customer colour selection or approved artwork and order details.

Returns for faulty products, incorrect products, or products that do not match their description are handled in accordance with our Return Policy.

Nothing in these Terms of Service or our Return Policy excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable law.

If there is a problem with an order, please contact us promptly with the order number, a description of the issue and clear photos where relevant so we can review the matter.

13. Customer-supplied garments

NS PROMO may agree to print or embroider customer-supplied garments after considering the garment type, condition, fabric and requested decoration method.

Customer-supplied garments can carry additional risks, including unexpected reactions to heat, pressure, ink, adhesive, hooping, needles or embroidery backing. These risks may be higher where the fabric composition, treatment, age or previous use of the garment is unknown.

Where we identify a particular concern before production, we will explain it where reasonably practical. You may be asked to approve the proposed method and identified risk before work begins.

NS PROMO is not responsible to the extent that damage or decoration failure is caused by an inherent defect, undisclosed treatment, incorrect fibre description, existing damage or unsuitability of a customer-supplied garment that could not reasonably have been identified beforehand.

This section does not exclude responsibility for a failure by NS PROMO to provide services with due care and skill or any liability that cannot legally be excluded.

14. Shipping, delivery and pick-up

Available delivery areas, shipping charges, estimated transit times and pick-up information are set out in our Shipping Policy and displayed at checkout where applicable.

Please ensure that the delivery name, address, phone number and delivery instructions are accurate before confirming an order.

Delivery timeframes are estimates unless expressly confirmed in writing as guaranteed. Courier delays, public holidays, peak periods, weather, remote destinations and incorrect delivery information may affect delivery.

For orders delivered by a carrier arranged by NS PROMO, responsibility for the goods generally remains with us until the goods are delivered to the nominated address, subject to any authority-to-leave instruction provided by the customer and applicable law.

If you independently arrange and control your own carrier or collection service, responsibility may pass when the goods are collected by that carrier, to the extent permitted by law.

Pick-up may be available by appointment from our Thornleigh showroom and production studio. We will notify you when the order is ready for collection.

15. Delivery problems

If an order appears delayed, lost, damaged or incorrectly delivered, please contact us so we can review the available information and assist with the courier or delivery provider where appropriate.

If an order arrives damaged, please keep the packaging and provide clear photos of the package, shipping label and affected goods as soon as reasonably possible.

Nothing in this section limits any rights or remedies available under applicable law.

16. Storage and uncollected orders

Customers are responsible for collecting or accepting delivery of completed orders within a reasonable time after notification.

If an order remains uncollected or cannot be delivered because of incorrect details, failed delivery attempts or lack of customer response, reasonable storage, handling or redelivery costs may apply.

We will attempt to contact you before taking further action in relation to a materially delayed or uncollected order.

17. Website use and availability

You must not misuse our website, attempt to gain unauthorised access, introduce malicious software, interfere with website operation or use the website for an unlawful or fraudulent purpose.

We aim to keep our website available and accurate but do not guarantee that it will always be uninterrupted or error-free.

We may update product descriptions, images, availability and prices. Changes will not affect an order that has already been accepted unless the change is agreed with the customer or required by law.

18. Intellectual property

Website content, text, images, designs, layouts, graphics and branding created by or for NS PROMO remain the property of NS PROMO or the relevant rights holder.

You must not copy, reproduce, publish or commercially use NS PROMO website content, mock-ups, designs or other materials without permission, except as permitted by law.

Customer-supplied logos and artwork remain the property of the customer or relevant rights holder. NS PROMO may use supplied artwork to provide the requested services, maintain production records, assist with repeat orders or where otherwise authorised by the customer.

19. Liability and consumer guarantees

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded, including rights under the Australian Consumer Law.

To the extent permitted by law, NS PROMO is not responsible for loss caused by:

• incorrect or incomplete information supplied by the customer;
• customer-approved artwork, spelling, size, colour, quantity or placement;
• the customer not having rights to use supplied artwork or content;
• customer misuse, unauthorised alteration or failure to follow care instructions;
• an inherent or undisclosed issue with a customer-supplied garment; or
• an event outside our reasonable control.

This exclusion applies only to the extent that the relevant loss was caused by that matter.

To the extent permitted by law, NS PROMO is not liable for indirect or consequential business loss that was not reasonably foreseeable when the order was accepted.

Nothing in this section excludes liability for our failure to exercise due care and skill, a material failure to supply agreed goods or services, or any other liability that cannot legally be excluded.

20. Privacy

Personal information is handled in accordance with our Privacy Policy.

21. Governing law

These Terms of Service are governed by the laws of New South Wales, Australia.

The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any mandatory rights or jurisdiction that applies under consumer or other applicable law.

22. Changes to these Terms of Service

We may update these Terms of Service when our products, services, systems or legal obligations change.

The version applying to an order is generally the version published or otherwise provided when that order was accepted, unless a change is required by law or agreed with the customer.
